Definition of a Building Owner
This is a person or company that is proposing to undertake the works and is either the freeholder or has a lease for longer than a year.
The Act is a facilitating Act that enables you as the Building Owner(s) to carry out your proposed building works whilst providng a level of protection to your Adjoining Owner(s) (neighbours) property, Adjoining Owner(s) cannot stop someone from exercising the rigths given to them by the Act, if the process is followed correctly.

Are your Building Works Notfiable?
Notice(s) under the Act should be served on your Adjoining Owner(s) if either one or all three of the following scenerios applies to your proposed building works and must be served either one month or two months prior to the works starting:
- Building on the Line of Junction that is not already built upon.
- Works affecting an existing Party Wall.
- Excavating within three / six metres of your neighbours property.
It is vital to get accurate advice at an early stage and our team of Party Wall Surveyors can offer that, to help avoid unncessary confrontation with your Adjoining Owner(s) and can advise you the Building Owner(s) on all Party Wall matters, we can be your Appointed Surveyor or act as the Agreed Surveyor if appointed also by your Adjoing Owner(s).
We can serve valid notice(s) on your behalf, this includes reviewing the proposed drawings, carrying out title searches on your Adjoining Owner(s), preparing a covering letter explaining about the Act and the options available, acknowledgement letters and if required Schedules of Condition and if a dispute arises draft, agree and issue an Award under the Party Wall Act.
